Union County Arrest Records and Court Charges

Union County arrest records are law-enforcement and custody records tied to an arrest event. They may identify the person arrested, the arresting or holding agency, booking date, listed charges, bond information, and custody location when the person is in jail. The Union County Sheriff is the local law-enforcement contact, but current custody lookup for Union County detainees runs through Webster County Detention Center because Union County detainees are housed there under the current regional custody setup found in the research.

Court charge records are narrower and more court-focused. They show the offense or offenses filed after an arrest or citation, the statute or charge description, case or citation number, court date, bond status, and whether each charge is pending, amended, reduced, dismissed, convicted, or sent to the grand jury. Booking details belong with the jail and sheriff side. The full criminal court case file and outcome are handled on the Union County criminal court records page.

Charges After Arrest Documents

Charges after arrest become part of the court record when a charging document or citation reaches the court. In Kentucky practice, a misdemeanor or traffic matter may move through District Court. A felony may start in District Court for arraignment or probable-cause hearing and then proceed toward Circuit Court. The prosecutor's role depends on offense level, with the County Attorney handling misdemeanors and violations, and the Commonwealth's Attorney handling felonies in Circuit Court.

Union County Charge Status

Charge status can change more than once. A charge may be listed at arrest, filed in court, amended by the prosecutor, reduced through plea negotiations, dismissed by order, sent to the grand jury, or resolved by conviction. Reading a charge record requires checking each charge separately because one case can contain several charges with different results.

StatusWhat It MeansPractical Meaning
PendingThe charge remains open and no final disposition has been entered.Check the next court date and bond or release terms.
AmendedThe charge description, count, or level changed by court action or prosecution decision.Compare the original charge with the current filed charge.
ReducedThe charge moved to a lower offense or less serious count. The final sentence or disposition may differ from the arrest charge.
DismissedThe court ended the charge without conviction.Confirm whether dismissal was with or without prejudice if that matters.
Sent to grand juryA felony matter moved toward grand-jury review or Circuit Court action.District Court may not show the final felony outcome.
ConvictedThe charge ended in a guilty plea, verdict, or finding.Review the sentence, costs, restitution, probation, and appeal entries.

Note: A listed arrest charge may not match the final filed charge or the charge of conviction.

Court Charges vs Convictions

A charge is not proof of guilt. It is an accusation filed after an arrest, citation, complaint, information, or indictment. A conviction is a court outcome after a guilty plea, verdict, or finding. Union County arrest records may show the initial allegation, while the court record shows what happened after the case moved through District Court or Circuit Court.

Who Files Union County Charges

Kentucky uses different prosecutor roles by case type. The Union County Attorney handles misdemeanor crimes punishable by one year in jail or less, violations punishable by fines but no jail time, juvenile criminal actions in District Court, dependency, neglect, abuse actions in Family Court, disability actions in District Court, child-support functions, and legal advice to Fiscal Court. The official County Attorney page names Julie Wallace and lists phone 270-389-0591.

Felony prosecution in Circuit Court is handled by the Commonwealth's Attorney. GRADD lists Zack Greenwell as Commonwealth's Attorney, P.O. Box 361, Marion, KY 42064, phone 270-965-2261. Defense representation for eligible Union County defendants is through the Kentucky Department of Public Advocacy Henderson Trial Office, 739 S. Main St., Henderson, KY 42420, phone 833-254-2463. Prosecutor and defense roles can affect whether a charge is amended, diverted, dismissed, pled, or tried.

Statewide Charge Record Limits

Union County charge information can appear in more than one system, but each system answers a different question. KYeCourts and the local court clerk relate to court cases. Easy Pay is useful for payable cases, citations, and court costs. Webster County Detention Center relates to current custody and booking. Kentucky Offender Online Lookup relates to sentenced state offenders, parolees, or supervised offenders after the local jail stage.

Criminal-history dissemination is subject to Kentucky rules. 502 KAR 30:060 addresses dissemination of criminal history record information. A court charge record is not the same as an official criminal-history background check, and a public court result may not tell whether a record is reportable, sealed, expunged, or suppressed from a state-performed background check.

Sealed and Expunged Charges

Union County charge records can be restricted. Juvenile court records are confidential under KRS 610.340 unless disclosure is authorized. Sealed records are blocked by statute or court order. Expunged records are removed or deleted from official state-performed background checks after the required court process and order.

KRS 431.079 defines expungement, and KRS 431.073 covers certain felony conviction expungements, including the fee imposed after an expungement order.

Restricted Union County Charge Records

Access limits can apply even when a person knows the name, date, or arrest agency. Active investigations, sealed warrants, juvenile matters, mental-health details, protected addresses, Social Security numbers, medical information, financial account data, and domestic-violence safety information may be withheld or redacted. KRS 61.878 identifies exempt public-record categories, and court confidentiality rules can add further limits.

Older charge records may also be harder to locate. KCOJ says the clerk can tell whether a case file is in the clerk's office, at a record facility, or destroyed under retention schedules. If the State Records Center is involved, the clerk must supply case and file locator numbers because stored records cannot be searched there by name or Social Security number.

Important: Do not treat a booking entry, charge line, or web search result as a final conviction without checking the court disposition.
